Love the jeans. Fix the waist.
A waistband that gaps does not always mean the whole pair is wrong. Start with these simple checks.

The legs fit, the length is right, but the waistband stands away from your back. Before buying another pair, work out whether you need a different cut, a small temporary adjustment or a permanent alteration.
First, check the whole fit
Try the jeans with the shoes and underwear you normally wear. Stand, sit and bend. If the thighs or hips already feel tight, sizing down just to fix the waist can trade one problem for another. If the jeans are loose everywhere, a smaller size or a different cut is usually the better starting point.
For a small gap: a belt or an adjuster
A belt is the simplest reversible option. Look for one that holds the waistband without bunching it excessively. A removable waistband adjuster can bring in a small section of fabric without sewing. It can help with a modest gap, but it will not change the rise, seat or shape of the legs.
If the adjuster uses pins, follow its fitting instructions. Check that the fastenings are secure before wearing it, remove it before washing and keep sharp pieces away from children. Delicate, coated or very stretchy fabrics may not be suitable.
For your favourite pair: ask a tailor
A tailor can assess how much can be removed while keeping pockets, seams and belt loops in proportion. Ask to see how the proposed alteration looks while you sit down, not just while standing in front of a mirror. Large changes are not always practical.
For your next pair: change the cut
Compare waist and hip measurements, rather than relying on a size label alone. A cut with more room through the hip relative to the waist may suit you better. Also compare rise: a waistband that sits at a different point on your body can fit very differently.
The useful distinction: a small waistband gap can be an adjustment problem. An uncomfortable seat, pulling across the hips or a slipping rise is more likely a fit problem.
